5. Booking, Payment, and Cancellation Terms

5.1 Booking Process

When you complete a booking through our Website, you are making an offer to purchase the selected services at the stated price. A booking is only confirmed when you receive a written booking confirmation from us by email. We reserve the right to decline any booking at our sole discretion.

It is your responsibility to carefully review your booking details prior to confirmation, including travel dates, routes, passenger information, vehicle details, and any selected add-ons. Amendments to confirmed bookings may be subject to administrative fees and changes in fare pricing.

5.2 Pricing and Payment

All prices displayed on the Website are quoted in Euro (€) unless otherwise stated, and include applicable Value Added Tax (VAT) in accordance with Irish and EU VAT legislation. We accept payment via credit card, debit card, and other electronic payment methods as displayed at the time of booking.

Prices are dynamic and subject to change at any time until the point of booking confirmation. The price applicable to your booking is the price confirmed at the time of purchase as displayed on your booking confirmation document.

All payments are processed securely in accordance with the Payment Card Industry Data Security Standard (PCI DSS). We do not store your full card details on our systems.

5.3 Cancellation and Consumer Rights

In accordance with the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013, which implements EU Directive 2011/83/EU on consumer rights into Irish law, consumers may have the right to cancel certain contracts within 14 days of conclusion (the "cooling-off period"). However, please note that the right of withdrawal may not apply to transport service contracts where a specific date or period of performance has been agreed, pursuant to Article 16(l) of the Directive.

Our specific cancellation and refund policy for ferry bookings is set out in our Cancellation Policy, which forms part of these Terms. Cancellation fees may apply depending on the time of cancellation relative to the scheduled departure date.

6. Limitation of Liability

To the fullest extent permitted by applicable Irish and EU law, Irish Ferries, its directors, officers, employees, agents, partners, and licensors shall not be liable for:

  • Any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of, or inability to use, our Website or Services;
  • Loss of profits, loss of revenue, loss of data, loss of goodwill, or any other economic loss, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise;
  • Any loss or damage arising from delays, cancellations, or disruptions to ferry services caused by adverse weather conditions, technical failures, industrial action, port closures, force majeure events, or circumstances beyond our reasonable control;
  • The accuracy, completeness, or currency of any information provided on the Website;
  • Any unauthorised access to or alteration of your data arising from circumstances beyond our reasonable control; or
  • Any damage to or loss of property, including vehicles, during the course of transport, except where such damage or loss results directly from our proven negligence.

Where our liability cannot be excluded by law, including under the Athens Convention relating to the Carriage of Passengers and their Luggage by Sea (as incorporated into EU law by Regulation (EC) No 392/2009), our total liability to you in respect of any claim shall be limited to the amount paid by you for the specific service giving rise to the claim, or such other limit as may be prescribed by applicable mandatory legislation.

Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Irish law.

7. Disclaimers

  • Third-Party Content: Our Website may contain links to third-party websites or services. We do not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party websites. Your use of third-party websites is entirely at your own risk;
  • Travel Information: Information provided regarding travel routes, schedules, port facilities, and visa requirements is provided for general guidance only. You are solely responsible for verifying the accuracy and currency of such information and ensuring that you comply with all applicable travel and immigration requirements.

The Consumer Protection Act 2007 and the Sale of Goods and Supply of Services Act 1980 (as amended) provide you with certain statutory rights that cannot be excluded by contract. Nothing in this disclaimer section is intended to limit or exclude those statutory rights.

8. Indemnification

You agree to fully indemnify, defend, and hold harmless Irish Ferries and its respective directors, officers, employees, agents, contractors, licensors, and successors from and against any and all claims, demands, actions, proceedings, losses, damages, costs, expenses (including reasonable legal fees), and liabilities of any kind arising out of or in connection with:

  • Your use of or access to our Website or Services;
  • Any breach by you of these Terms or any applicable law or regulation;
  • Any content, information, or data you submit, post, or transmit through our Website;
  • Your infringement of any intellectual property, privacy, or other rights of any third party;
  • Any wilful misconduct, negligence, or fraudulent act by you; or
  • Any claim by a third party arising from your use of our Services, including damage caused by your vehicle or personal property to third parties or Company property.

We reserve the right, at our own expense, to assume exclusive defence and control of any matter otherwise subject to indemnification by you. In such cases, you agree to cooperate fully with our defence of such claims and not to settle any such matter without our prior written consent.

9. Force Majeure

Irish Ferries shall not be liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to:

  • Adverse weather conditions, storms, fog, or other meteorological events;
  • Acts of God, natural disasters, earthquakes, or floods;
  • Acts of war, terrorism, civil unrest, riots, or governmental actions;

  • Epidemics, pandemics, or public health emergencies declared by competent authorities;
  • Failure of telecommunications networks, internet connectivity, or power supply; or
  • Regulatory changes, new legislation, or orders issued by government bodies that materially affect our ability to operate.

In the event of a force majeure situation affecting your scheduled crossing, we will make reasonable efforts to notify you promptly and, where possible, offer alternative arrangements or refunds in accordance with applicable consumer protection law and EU passenger rights regulations.

10. Privacy and Data Protection

Irish Ferries is committed to protecting the privacy and personal data of all users of our Website and Services. The collection, processing, storage, and use of personal data are governed by our Privacy Policy, which complies with the following applicable legislation:

  • The General Data Protection Regulation (EU) 2016/679 ("GDPR");
  • The Data Protection Acts 1988–2018 (Ireland);
  • The ePrivacy Directive 2002/58/EC (as implemented in Ireland); and
  • Any subsequent amendments, implementing measures, or successor legislation.

The Data Protection Commission (DPC) is the supervisory authority responsible for overseeing data protection compliance in Ireland. You have the right to lodge a complaint with the DPC at any time if you believe that your personal data has been processed in a manner that does not comply with applicable data protection law.

By using our Website and Services, you acknowledge that you have read and understood our Privacy Policy and consent to the processing of your personal data in accordance therewith.

11. Governing Law and Jurisdiction

These Terms of Service and any dispute, claim, or matter arising out of or in connection with these Terms, including their formation, interpretation, performance, or enforceability, shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.

You irrevocably agree that the courts of Ireland shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter, save that we reserve the right to bring proceedings against you in any other jurisdiction where you are domiciled or where your conduct giving rise to a claim has taken place.

Nothing in this clause shall limit the rights of consumers to bring claims before the courts of their country of habitual residence where such rights are granted by applicable mandatory EU consumer protection legislation, including but not limited to Council Regulation (EC) No 44/2001 (Brussels I Regulation) and its successor instruments.

These Terms are also subject to applicable EU regulations governing maritime passenger rights, including Regulation (EU) No 1177/2010 concerning the rights of passengers when travelling by sea and inland waterway.

12. Dispute Resolution

12.1 Informal Resolution

In the event of any dispute, complaint, or concern arising from your use of our Website or Services, we encourage you to contact us in the first instance to seek an informal resolution. Please reach out to our customer service team at [email protected] with full details of your complaint. We will endeavour to respond to your complaint within 10 business days and to resolve the matter to your satisfaction within 30 days of receipt.

12.2 Alternative Dispute Resolution

If we are unable to resolve a dispute informally, you may have the right to use alternative dispute resolution (ADR) mechanisms. In accordance with EU Directive 2013/11/EU on consumer ADR and Regulation (EU) No 524/2013 on online dispute resolution, consumers may submit complaints through the European Commission's Online Dispute Resolution (ODR) platform, accessible at: https://ec.europa.eu/consumers/odr.

Additionally, consumers in Ireland may seek assistance from the following bodies:

  • Competition and Consumer Protection Commission (CCPC) — providing consumer information and assistance;
  • Commission for Aviation Regulation — for matters relating to passenger rights on applicable routes;
  • Small Claims Court — for claims not exceeding €2,000, providing a low-cost resolution mechanism under the Courts Service of Ireland.

12.3 Arbitration

For commercial disputes between business users and Irish Ferries, where the parties are unable to reach an informal resolution, either party may refer the dispute to binding arbitration under the Arbitration Act 2010 (Ireland), which adopts the UNCITRAL Model Law on International Commercial Arbitration. Such arbitration shall be conducted in Dublin, Ireland, in the English language.

13. Term and Termination

13.1 Duration

These Terms come into effect from the moment you first access our Website or use our Services and shall remain in full force and effect for as long as you continue to use the Website or Services, unless terminated earlier in accordance with these Terms.

13.2 Termination by You

You may terminate your relationship with us at any time by ceasing to use our Website and Services and, where applicable, by closing your account. Termination of your account does not affect any existing bookings, outstanding payment obligations, or any rights and liabilities that have accrued prior to termination.

13.3 Termination by Us

We reserve the right to suspend, restrict, or terminate your access to our Website and Services, with or without notice, if:

  • You breach any provision of these Terms;
  • We reasonably suspect fraudulent, abusive, or illegal activity on your account;
  • We are required to do so by law or order of a competent authority;
  • We decide, at our sole discretion, to discontinue all or part of our Services; or
  • Your use of the Website or Services poses a risk to the safety, security, or integrity of our systems or other users.

13.4 Effect of Termination

Upon termination, all licences and rights granted to you under these Terms shall immediately cease. Provisions of these Terms that by their nature should survive termination, including sections relating to intellectual property, limitation of liability, indemnification, governing law, and dispute resolution, shall continue to apply after termination.

14. Changes to These Terms

We reserve the right to update, amend, or replace these Terms of Service at any time in response to changes in applicable law, regulatory requirements, our business practices, or for any other reason we deem appropriate. Any changes will be published on this page with a revised "Last Updated" date.

Where changes are material, we will make reasonable efforts to provide you with prior notice, which may include displaying a notice on our Website or sending an email to registered account holders. It is your responsibility to review these Terms periodically to stay informed of any updates.

Your continued use of our Website or Services following the publication of updated Terms constitutes your acceptance of and agreement to be bound by the revised Terms. If you do not accept the revised Terms, you must immediately cease using our Website and Services.

15. Severability

If any provision of these Terms is found by a court, tribunal, or other competent authority to be invalid, unlawful, void, or unenforceable under applicable law, that provision shall be deemed severed from these Terms to the minimum extent necessary and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.

Where a provision is found to be partially invalid or unenforceable, the parties agree that the offending part shall be modified to the minimum extent necessary to make it valid and enforceable, while preserving the original intent of the parties as closely as possible.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy, Cancellation Policy, and any other policies or notices published on the Website, constitute the entire agreement between you and Irish Ferries with respect to your use of the Website and Services, and supersede all prior negotiations, representations, warranties, and understandings between the parties relating to the same subject matter.

No failure or delay by either party in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. A waiver of any breach of these Terms shall not be construed as a waiver of any subsequent breach of the same or any other provision.

17. Third-Party Rights

These Terms do not confer any rights on any third party. Nothing in these Terms is intended to create, or shall be construed as creating, any right enforceable by any person who is not a party to these Terms, whether under the Contracts (Rights of Third Parties) Act or otherwise, except that this clause does not affect any right or remedy of a third party that exists or is available apart from these Terms.

18. Assignment

You may not assign, transfer, or sub-contract any of your rights or obligations under these Terms without our prior written consent. We reserve the right to assign, transfer, or sub-contract our rights and obligations under these Terms, in whole or in part, to any affiliate, successor entity, or third party, including in connection with a merger, acquisition, corporate restructuring, or sale of assets, provided that such assignment does not adversely affect your rights under these Terms.

19. Language

These Terms of Service are drafted in the English language. In the event of any inconsistency or discrepancy between the English version and any translated version of these Terms, the English language version shall prevail and take precedence in all respects.
